Acceptance of Terms
By accessing our website at imaginationoverdrive.com, submitting a contact form, or booking any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Services Description
Imagination Overdrive provides event decor, entertainment, and related services throughout the state of Florida, including but not limited to:
- Event decor and balloon installations (arches, columns, sculptures, ceiling treatments, full-venue transformations)
- Live event entertainment (balloon artists, face painters, magicians, caricaturists, stilt walkers, and specialty performers)
- Seasonal and holiday decor programs (Halloween, Christmas, and other seasonal installations)
- Event consultation and design services
Booking & Deposits
All bookings are subject to the following terms:
- A non-refundable deposit of 50% of the total quoted price is required to secure your event date
- The remaining balance is due no later than 48 hours before the scheduled event
- Bookings are not confirmed until the deposit has been received and a written confirmation is provided by Imagination Overdrive
- Prices quoted are valid for 30 days from the date of the proposal, unless otherwise specified
- Additional services or changes requested after the initial booking may result in adjusted pricing
Cancellation Policy
We understand that plans can change. Our cancellation policy is as follows:
- 14+ days before the event: Full deposit refund, or the deposit may be applied to a rescheduled date within 12 months
- 7–13 days before the event: 50% of the deposit may be applied toward a rescheduled date within 6 months; no cash refund
- Less than 7 days before the event: The deposit is non-refundable and non-transferable
- Rescheduling: One complimentary reschedule is permitted with at least 14 days' notice, subject to availability
Liability
Imagination Overdrive takes great care in providing professional services. However, we must outline the following limitations of liability:
- Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific event in question
- We are not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services
- Force Majeure: We are not responsible for cancellations or delays caused by circumstances beyond our reasonable control, including but not limited to severe weather, hurricanes, natural disasters, power outages, venue closures, government restrictions, or other acts of God
- For outdoor events, we will make every reasonable effort to adapt to weather conditions, but we cannot guarantee specific outcomes when weather is a factor
- We carry general liability insurance for all events we service
Intellectual Property
All intellectual property rights related to Imagination Overdrive are protected:
- The Imagination Overdrive name, logo, and all associated branding materials are the property of iBalloon LLC and may not be used without written permission
- We reserve the right to photograph and document our installations and event work for use in our portfolio, website, social media, and marketing materials, unless the client explicitly requests otherwise in writing prior to the event
- All original designs, concepts, and proposals created by Imagination Overdrive remain our intellectual property
- Clients may share photos of our work with appropriate credit to Imagination Overdrive
Client Responsibilities
To ensure a successful event, clients agree to:
- Provide accurate event details including date, time, venue address, guest count, and any special requirements
- Ensure our team has adequate access to the venue for setup and breakdown, including any required load-in times or venue-specific rules
- Communicate any changes to event details in a timely manner (at least 7 days before the event when possible)
- Obtain any necessary permissions or permits from the venue for decor installations
- Ensure a safe working environment for our team, free from hazards
- Designate a point of contact who is available on the day of the event
Indemnification
You agree to indemnify, defend, and hold harmless Imagination Overdrive, iBalloon LLC, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your breach of these terms, or your violation of any applicable law or the rights of any third party.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.
Changes to Terms
We reserve the right to modify or update these Terms of Service at any time. Changes will be posted on this page with a revised "Last Updated" date. Continued use of our website or services after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
